Family Class Sponsorship Canada: What’s New Updates

Family Class Sponsorship Canada: Family class sponsorship is a valuable pathway that allows Canadian citizens and permanent residents to reunite with their loved ones and create a supportive environment for their families to thrive. By providing detailed information and insights, we aim to help you understand the intricacies of family class sponsorship and empower you to navigate the process successfully.

Family Class Sponsorship

Family class sponsorship is a program the Canadian government offers that enables eligible Canadian citizens and permanent residents to sponsor their close family members for permanent residency in Canada. This program allows individuals to reunite with their spouses, partners, dependent children, parents, and grandparents.

Benefits of Family Class Sponsorship Canada

Family class sponsorship holds several advantages for sponsors and sponsored family members. For sponsors, it offers the joy of reuniting with their loved ones and building a life together in Canada. Additionally, the Canadian government strongly emphasizes family reunification, which can result in faster processing times for family class sponsorship applications.

For the sponsored family members, the benefits are substantial as well. They can live, work, and study in Canada permanently, access healthcare and social services, and eventually apply for Canadian citizenship. Family class sponsorship facilitates the creation of strong family bonds and enables individuals to establish their lives in a welcoming and inclusive country like Canada.

Eligibility Criteria for Sponsors

To sponsor a family member under the family class sponsorship program, sponsors must meet certain eligibility criteria. The following sections outline the key requirements for different relationships:

Sponsoring a Spouse, Partner, or Conjugal Partner

As a sponsor, you can apply to bring your spouse, common-law partner, or conjugal partner to Canada. The eligibility criteria for this category include:

  1. Being at least 18 years old
  2. Being a Canadian citizen or permanent resident
  3. Demonstrating the genuine nature of the relationship
  4. Proving that you are not receiving social assistance for reasons other than a disability

Sponsoring Dependent Children

Canadian citizens and permanent residents can also sponsor their dependent children to join them in Canada. The eligibility criteria for sponsoring dependent children include:

  1. Being a Canadian citizen or permanent resident
  2. Demonstrating the ability to provide financial support to the child
  3. Ensuring the child is under the age of 22 and does not have a spouse or common-law partner
  4. Demonstrating that the child is financially dependent on the sponsor

Sponsoring Parents and Grandparents

Sponsoring parents and grandparents fall under the Family Class program, which has a different application process. The Canadian government holds periodic intake periods for sponsoring parents and grandparents. Eligibility criteria for sponsoring parents and grandparents include:

  1. Being a Canadian citizen or permanent resident
  2. Meeting the minimum income requirements to prove the ability to support the sponsored family member financially
  3. Signing an undertaking to support the sponsored family member for a specified period financially

The Application Process

The application process for family class sponsorship involves several steps and requires careful attention to detail. Here’s an overview of the process:

Step 1: Determine Eligibility and Gather Documents

Before applying, it is crucial to ensure that both the sponsor and the sponsored family member meet the eligibility criteria. Gathering the necessary supporting documents, such as identification, relationship proof, and financial records, is an important part of this step.

Step 2: Complete and Submit the Application

Once the eligibility and document requirements are fulfilled, the sponsor must complete the application forms accurately. Providing comprehensive and truthful information is essential to avoid delays or potential refusal.

Step 3: Pay Fees and Await Processing

After applying, the sponsor needs to pay the required processing fees. The application will then be processed by Immigration, Refugees and Citizenship Canada (IRCC), and it is crucial to allow sufficient time for processing.

Step 4: Attend Interviews and Provide Additional Information

In some cases, sponsors and sponsored family members may be required to attend interviews with an immigration officer. Additionally, the IRCC may request additional information or documentation during the processing of the application.

Step 5: Decision and Next Steps

Upon completing the application assessment, the IRCC will notify the sponsor of the decision. If approved, the sponsored family member will receive instructions for the permanent residency process.

Family class sponsorship is a remarkable opportunity for Canadian citizens and permanent residents to reunite with their loved ones and create a nurturing environment in Canada. By understanding the eligibility criteria and diligently following the application process, sponsors can bring their families to Canada successfully.

New steps to help families get back together have been announced.

Immigration Minister Sean Fraser announced changes strengthening Canada’s family class of immigration on May 26, 2023. He said that if Canada wants to stay a top choice for newcomers, it must also have ways to welcome their families.

Family members from countries requiring visas who have applied for permanent residency in Canada under the family class can apply for Temporary Resident Visas (TRVS) to join their family in Canada. Too often, though, many of these applications are denied because the people aren’t likely to return home. Even after their application has been handled, more than 90% are given permanent residency.

The IRCC is happy to say that by using new technology and simplifying their processes, they have improved how they handle visas for family members. The TRV waiting list for family members with permanent residency applications has been cleared. This new process has accepted more than 98% of TRV applications for spouses and their dependent children. This will let more families stay together while their PR forms are processed.

From now on, it will take 30 days to process an application for a TRV. Also, these modernization attempts have made it possible to process new PR applications within 12 months.

The IRCC is also starting a new program to help people who just moved to Canada support themselves and their families as quickly as possible. Before, these open work permits could only be applied for by people already in Canada. The last big change mentioned today is that people with an open work permit that expires at the end of 2023 can extend it for 18 months for free starting on June 7.

This includes the spouses and dependent children of most temporary workers, the spouses and dependent children of foreign students and PR applicants waiting for their permanent residency approval. This will likely affect about 25,000 people in Canada who are not allowed to work.

Summary:

  1. Improved Family Class Sponsorship
  2. Streamlined Family Visa Processes
  3. Quick TRV Acceptance Rates
  4. Faster Permanent Residency Applications
  5. Open Work Permits for Family
